Terms of Service

1. Acceptance

By accessing the website lumos.property or using our services (waitlist, forms, beta program), you agree to be bound by these terms. If you do not agree with any clause, you must stop using our services.

These terms apply to all visitors and users of the website lumos.property. Use of the inspector application (inspector.lumos.property) is governed by separate terms.

2. Identity of the Provider

Lumos Intégrité Inc. is the owner of Lumos Inspection, Lumos Clarity, and Lumos Property Health.

3. Beta Phase and Availability

Lumos Inspection is in private beta at the time of publication of these terms. By joining the waitlist or beta program, you acknowledge that:

  • The software is in active development and may contain bugs or incomplete features
  • We provide the beta "as is" without any warranty
  • Features, pricing, and access conditions may change before commercial launch
  • Your feedback helps us improve the product, and we thank you for it

4. Registration and Accuracy of Information

When registering for the waitlist or beta program, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the confidentiality of your account credentials
  • Notify us without delay of any unauthorized use of your account
  • Not create an account under a false identity

You are solely responsible for all activities carried out from your account.

5. Acceptable Use

You agree to use our services only for lawful purposes. You may not:

  • Transmit malicious code, viruses, or harmful software
  • Attempt to access our systems or those of our users without authorization
  • Circumvent our security measures or test them without our written authorization
  • Violate applicable laws, including Law 25 and the Copyright Act
  • Infringe on anyone's intellectual property rights
  • Harass, abuse, or harm other users
  • Use our services for competitive purposes or to extract content for commercial use without our written agreement

6. Intellectual Property

All content on lumos.property (text, graphics, logos, icons, images, interfaces, source code, databases) is the exclusive property of Lumos Intégrité Inc. or its licensors, and is protected by Canadian and international copyright and trademark laws.

You may not copy, modify, distribute, publish, retransmit, or reverse engineer any part of our services without our prior written authorization.

The "Lumos" trademark, the Lumos logo, and the names "Lumos Inspection," "Lumos Clarity," and "Lumos Property Health" are trademarks of Lumos Intégrité Inc.

7. Comments and Suggestions

If you send us comments, suggestions, or ideas about our services, you grant us a non-exclusive, perpetual, irrevocable, worldwide, royalty-free right to use, reproduce, modify, and incorporate those comments into our products without obligation to you. You waive all moral rights in those comments to the extent permitted by law.

8. Privacy

Your use of our services is also governed by our Privacy Policy, which forms an integral part of these terms.

9. Links to Third-Party Sites

Our site may contain links to third-party sites. We have no control over the content of those sites and assume no responsibility for their availability, accuracy, or privacy practices. Visiting those sites is at your own risk.

10. Disclaimer of Warranties

To the fullest extent permitted by law, our services are provided "as is" and "as available." Lumos Intégrité Inc. does not warrant that:

  • The services will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The services will meet your expectations or specific needs
  • Results obtained through use of the services will be accurate or reliable

This clause does not limit the warranties provided by Quebec's Consumer Protection Act, where applicable.

11. Limitation of Liability

To the fullest extent permitted by law, Lumos Intégrité Inc., its directors, employees, and partners are not liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from service interruption, error, omission, virus, or defect

In any event, our total liability for any claim arising from these terms is limited to the amounts you have actually paid us during the twelve months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Lumos Intégrité Inc. against any claim, damage, cost, or expense (including reasonable legal fees) arising from your use of the services in violation of these terms.

13. Modifications to Services and Terms

We may modify, suspend, or discontinue all or part of our services at any time, without notice.

We may also modify these terms. In the event of a significant change, we will:

  • Post the new terms on this page
  • Update the "Last updated" date
  • Notify you by email if you are registered on our waitlist or beta program, at least 30 days before the changes take effect

If you do not agree with the changes, you must stop using our services. Continued use after the effective date constitutes acceptance.

14. Termination

You may stop using our services at any time by asking us to remove your information from our systems (see our Privacy Policy).

We may terminate or suspend your access to our services at any time, with or without notice, for:

  • Violation of these terms
  • Conduct harmful to our other users, to us, or to third parties
  • Legal or regulatory requirements
  • Documented operational reasons

Upon termination, clauses that by their nature must survive (intellectual property, limitation of liability, indemnification, governing law) remain in effect.

15. Governing Law and Jurisdiction

These terms are governed by and interpreted in accordance with the laws applicable in the Province of Quebec and the laws of Canada that apply therein, without regard to conflict of law rules.

Any dispute arising from these terms or relating to our services shall be submitted to the exclusive jurisdiction of the courts of the judicial district of Longueuil, Province of Quebec, Canada.

16. Compliance with Law 25

Lumos Intégrité Inc. is subject to Quebec's Act respecting the protection of personal information in the private sector, modernized by Law 25. Our personal information processing practices comply with the obligations of this law. See our Privacy Policy for details.

17. Entirety and Severability

These terms, combined with our Privacy Policy and any specific agreement signed between you and Lumos Intégrité Inc., constitute the entire agreement between the parties.

If any clause is found to be invalid or unenforceable, the remaining clauses remain in full force and effect. The invalid clause shall be replaced by a valid clause that most closely reflects the original intent.

18. Language

These terms are drafted in French. An English version may be provided as a courtesy translation. In the event of a discrepancy, the French version prevails.
